Venice Commission: The Supreme Court of Ukraine probably acted under the influence of a conflict of interest

The Venice Commission reminds that the fight against corruption is a vital element of a state

The decision of the Constitutional Court of Ukraine (CCU), adopted on 27 October, to declare some provisions of anti-corruption legislation unconstitutional has no clear reasoning, solid foundations in international law and was probably taken under the influence of some judges' conflicts of interest. This is stated in the urgent conclusion of the Venice Commission of the Council of Europe, adopted at the request of President of Ukraine Volodymyr Zelensky with a request to assess the constitutional situation caused by the decision of the CCU on anti-corruption legislation. The conclusion of the Venice Commission was announced on Wednesday, December 9.

Respect the Constitution and the interests of society

The Venice Commission reminds that the fight against corruption is a vital element of a state governed by the rule of law, as well as respect for the Constitution.

"The Constitutional Court, on the one hand, deserves institutional respect, but, on the other hand, must respect its own procedures and, for the sake of constitutional stability and legal certainty, must make decisions that are generally in line with its own case law," the conclusion reads.
